Litigation is simply a highly structured form of dispute resolution. Unfortunately, it is also expensive and a “zero sum” game: someone wins and someone loses. Experienced businesses, in particular, historically avoid the risk of litigation where possible. In some cases, it is unavoidable. Assessing whether to litigate or not is a crucial analysis. Alternatives such as mediation and arbitration need to be explored.
